Less serious drivers hours and tachograph offences can be dealt with at Magistrates’ Court.

With both tachograph and drivers hours offences, there is the possibility that a conviction or issuing of a fixed penalty will lead to a further investigation by the Traffic Commissioners office.

If this was to happen this could have consequences for the operators goods vehicle operator licence or the professional commercial drivers driving licence.

If an investigation takes place this will include a visit by the Driver and Vehicle Standards Agency ( DVSA, also previously known as VOSA) ,

This could lead  them to want to check your tachograph records and see  what systems, checks and procedures you have in place in respect of record keeping.

This is then likely that they will want to remove tachograph charts and digital information for analysis.

The investigation may include DVSA ( VOSA ) staff  interviewing both drivers, operator and company owner under caution.
